Buying Watches

Introduction

This section, along with other specifically referenced documents, set out the terms and conditions which are applicable when buying your watch via Chronotrade Limited. These terms and conditions will apply to any agreement (contract) between us for the purchase of your watch through us. Please make sure that you understand them, before buying any items through us. By buying any items through us, you agree to these terms and conditions and the other documents specifically referred to in it.

If you do not accept these terms and conditions, you will not be able to purchase your watch via the Chronotrade Website.

Please read these terms and conditions in conjunction with our "Data Privacy Policy".

We draw your attention to our limitation of liability clauses outlined in section 9.

1. Definitions

The following definitions apply in these terms and conditions:

Business Day: a day other than a Saturday, Sunday or public holiday in England.

Business Trader: a person or entity who buys and or sells watches on a commercial basis, has its business registered at Companies House and is VAT registered. Chronotrade Limited will categorise your account type as "trade" if you are a Business Trader. Only Business Traders can buy watches via the auction area of our Website.

Item, Watch: the watch (or any part of it) that you wish to sell through us together with any accompanying box, associated sales/marketing literature and other documentation (where applicable).

Listing: the posting of your watch information (including any related photographs of your watch) on our Website.

Paperwork: the original warranty certificate of the Item(s), which includes the name of the authorised dealer that originally sold the Item(s), the serial number of the Item(s) and the date of original sale of the Item(s).

Private Buyer a person who buys a watch or watches for their own private purposes only and not for commercial purposes. Chronotrade Limited will categorise your account type as "private" if you are a Private Buyer.

Private Seller: a person who sells a watch or watches for their own private purposes only and not for commercial purposes. Chronotrade Limited will categorise your account type as "private" if you are a Private Seller.

Services: the services provided by Chronotrade Limited, including the provision of a technology platform that brings together watch sellers and buyers via online shop and auction functionality, the provision of notification services throughout the buying and selling processes, the provision of authentication services for watches being sold by Private Sellers, and the carrying out of due diligence checks in respect of Business Traders.

We, us, our: Chronotrade Limited (registered in England and Wales with company number 11287263, and VAT registration number 302496225.

Website: the Website at the domain www.chronotrade.co.uk.

You, your: a Private Buyer or Business Trader who wishes to buy a watch or related Item through us.

  1. Clause headings shall not affect the interpretation of these terms and conditions.
  2. Unless the context otherwise requires, words in the singular shall include the plural, and in the plural shall include the singular.

2. CHRONOTRADE LIMITED'S AGREEMENT WITH YOU

  1. You acknowledge you are 18 years of age or over.
  2. Your agreement (contract) with us commences once we provide you an order confirmation email.
  3. When you submit an order on-line with us, you are making a request to purchase. Your order is not accepted by us until we provide you with an order confirmation email.
  4. Only Item(s) detailed in the order confirmation email from us to you are in the agreement.
  5. Items listed on our Website are subject to availability. If we cannot provide you with the requested Item(s) submitted via your order, we will advise you by email and or telephone and we will cancel your order.
  6. Items you have requested to purchase will remain available for sale on our Website until you have paid us in full.
  7. We cannot guarantee that the packaging provided with your Item(s) is authentic.
  8. Whilst we endeavour to ensure the images of Items posted on our Website are accurate, we cannot guarantee how your computer or device will render the images that appear on our Website.

3. ORDERS, PRICE AND PAYMENT

  1. All prices shown on our Website and all payments made to us will be in Great British Pounds (GBP) Sterling. If we need to refund any sum to you, this will also be in GBP Sterling. Any exchange rates that may apply will be your responsibility.
  2. All prices for Item(s) listed on our Website will be inclusive of VAT, or exempt of VAT, as applicable.
  3. Before you complete your order on our Website, it is important that you check all the details carefully before finally submitting your order.
  4. If your order is accepted by the Seller, you will be notified by email that your order is confirmed. You should not consider your order is accepted unless and until you receive an order confirmation email from us.
  5. Items for purchase on our Website are subject to availability. If a Seller withdraws their Item(s) from sale, and you have already paid for the Item(s), we will refund you the full amount you have paid us within 3 Business Days.
  6. You can cancel your order at any time before it is dispatched to us by the Seller.
  7. You must pay for your Item(s) when you place your order with us. We will not dispatch the Item(s) you have ordered until your funds have cleared into our bank account.
  8. If you are a Business Trader you can purchase Item(s) via the auction area of our Website. If you bid for an Item using our auction area, you will receive email notification advising whether or not your bid has been successful. If your bid is successful, you must pay for your Item(s) within 2 Business Days of receiving notification from us informing you that your bid has been successful. If you do not make payment in full to us within this time period, the Item(s) may be re-auctioned or listed for sale in the online shop area of our Website.
  9. You can pay by any of the following methods:
    1. Credit/Debit Card. Your credit/debit card needs to support 3D secure authentication which means that your card provider may ask you for a password that is already held with them once the card provider has approved your payment. Any applicable card charges will be detailed on your order summary.
    2. Bank Transfer. We accept BACS, CHAPS and same day faster payments. Our bank details will be provided to you when you complete your order on our Website.
    3. Cash. We may in certain circumstances accept a cash payment from you in our showroom. We will not accept cash payments that exceed £9,000. If you pay us by cash, we may ask you for proof of identity and proof of address. Proof of identity will need to take the form of either a current valid UK Passport or a current valid driving license. Proof of address will need to take the form of a recent council tax or utility bill.
    4. When you place your order with us on our Website, the order summary page will detail a breakdown of all applicable charges, including any relevant credit/debit card charges and any delivery charges.
    5. Please note that we do not offer part exchanges for Item(s).
    6. If you are a Business Trader, we will only accept payment via debit card, cash or bank transfer, and not via credit card.

4. DELIVERY TO YOU

  1. Please ensure you provide full and accurate delivery instructions in respect of your nominated delivery address. We cannot be liable for incorrect or inaccurate delivery information. We will use the delivery address detailed in your order placed with us on our Website.
  2. We will post your Item(s) to your nominated delivery address as detailed in your order using the Royal Mail Special Delivery service unless otherwise agreed mutually with you in advance. Please allow up to 3 Business Days for delivery, further to authentication, where applicable.
  3. Charges for your delivery will be detailed on the Order Summary page when you place your order with us. Note that there are likely to be additional charges for deliveries outside of mainland U.K.
  4. You or someone in your household must sign for the delivery and that person must be 18 years of age or older. If the carrier tries to deliver to your nominated delivery address but no one is available, then the carrier will leave an advice card for you to either arrange for another delivery or for you to pick up your Item(s) from a local collection office.
  5. We advise that you do not accept a parcel that appears to have been damaged, opened or tampered with. It will not be our liability if you have signed for a package that has been opened, damaged or tampered with when it arrives at your nominated delivery address.
  6. Delivery of the Item(s) will be considered complete once you have formally accepted the delivered package. Once the delivery is complete, the Item(s) are your responsibility.
  7. You will own the Item(s) once we have received payment in full from you.
  8. We will deliver outside of the UK, but excluding the countries listed in clause 4.9 below. We will use UPS or a similar carrier service. Expected delivery dates will be estimated only, and we cannot be liable for any delays in delivery due to events we cannot control.
  9. Please note that there are certain countries that we do not deliver to. These countries are: Afghanistan, Algeria, Angola, Armenia, Azerbaijan, Cuba, Democratic Republic of Congo, Ethiopia, Indonesia, Iran, Iraq, Kazakhstan, Kyrgyzstan, Kosovo, Lebanon, Liberia, Libya, Myanmar, Nicaragua, Nigeria, North Korea, Pakistan, Rwanda, Serbia, Sierra Leone, Somalia, North Sudan, South Sudan, Syria, Tajikidan, Turkmenidan, Uganda, the countries forming the former USSR, Yemen, Zimbabwe.

5. DUTY AND TAXES

If you are not resident or you are not based in the U.K., you may also have to pay duty or other taxes, fees and charges applied by customs or other such authorities. You must comply with all laws and regulations of your jurisdiction. You must pay for any additional charges for customs clearance. It is important to note that Chronotrade Limited has no control over these costs and cannot advise what such costs may be. Please note that Chronotrade Limited cannot be liable for any delays at customs.

6. WARRANTY

  1. Some Items we sell will come with a manufacturer's warranty. Please refer to the accompanying Paperwork and go to the manufacturer's Website for more information.
  2. If you purchase Item(s) that do not come with Paperwork containing a manufacturer's warranty, Chronotrade Limited will not provide you with a warranty.
  3. Please note that a manufacturer's warranty comes in addition to your consumer rights.
  4. Please note that Chronotrade Limited will not authenticate or warrant Paperwork or any accompanying box.

7. CANCELLATION AND RETURNS POLICY

  1. Pursuant to the clauses below, you have the right to cancel your order with us within 14 days of the date of purchase and receive a refund.
  2. If you cancel your order with us and your Item(s) have not yet been dispatched to you, you will receive a full refund within 14 days of placing your order.
  3. Your watch will come with a tamper-proof seal. This allows you to try on the watch and examine it for any faults. You must examine the Item(s) thoroughly before removing the seal. By removing the seal, you are confirming that further to thorough inspection, you have not found any faults with your watch.
  4. If you cancel your order with us and your Item(s) have already been dispatched by us, it is your responsibility to return the Item(s) to us safely and in their original condition as supplied to you with the seal unbroken. You acknowledge that if the seal we have placed on the watch has been broken, we will consider the watch no longer in its original condition as supplied to you and therefore, we will not be able to provide you with a refund.
  5. It is your responsibility to inspect your Item(s) as soon as they are delivered to you.
  6. If the Item(s) are faulty, it is imperative that you advise us immediately by telephoning and emailing us using the contact details on our Website www.chronotrade.co.uk, providing us with a full and accurate description of the nature of the fault(s).
  7. If you return Item(s) to us, you must use a tracked delivery service such as Royal Mail Special Delivery.
  8. If you return your Item(s) because you have decided not to go ahead with the purchase (and not because the Item(s) are faulty), we will refund you in full, as long as the Items are returned to us in their original condition with the seal unbroken.
  9. If you return your Item(s) because you have decided not to go ahead with the purchase (and not because the Item(s) are faulty), it will be your responsibility to cover the cost of packaging, postage and insurance as applicable.
  10. If you return your Item(s) because the Item(s) are faulty and you have advised us promptly of the situation, we will also refund you for any applicable posting and insurance costs, substantiated by receipts provided by you to us.
  11. If you return your Item(s) to us because you have found a fault and you have advised us immediately of the situation, it is important that you return the Item(s) promptly.
  12. We will examine the Item(s) that you advised us were faulty on delivery, once you return the Item(s) to us. As long as the fault was not made known to you at the time you purchased the Item(s), taking into account Clauses 7.3, 7.4, and 7.6 above, and Clause 7.13 below, you will be entitled to a refund.
  13. It is important that you follow our reasonable instructions regarding returning an Item(s). Please refer to the guides on our Website www.chronotrade.co.uk for details in respect of packaging and posting Item(s).
  14. If you purchased multiple Items in an order, we will only refund the part of the order that is faulty.
  15. You acknowledge that the Paperwork that accompanies a watch is part of the integral value of the Item. If you return your Item(s) without the Paperwork that we supplied to you, we will make a deduction from the refund of up to 30% in recognition of the reduction to the value of the Item(s).
  16. You acknowledge that a refund will not be provided if you try to cancel your order more than 14 days after the date of purchase of the Item(s), that is, 14 days after the date we emailed you with confirmation of your order.
    1. If in the event of us having to cancel your order before your Item(s) are delivered, due to circumstances outside of our control, we will contact you as soon as possible and advise you of the situation.
    2. In the event we have to cancel your order and you have already made a payment in advance of your Item(s) being delivered, we will refund to you the sum you have paid relating to the Item(s) that you have not received, within 7 Business Days, unless we reasonably suspect a fraudulent card payment has taken place.

8. WATCH PARTICULARS

  1. You acknowledge that if an Item is described as ‘water resistant', it does not mean it is 'water proof'. It is important that you refer to the manufacturers' recommendations and guidelines with regard to water resistance. We recommend that you have a regular water-resistance check performed once every year if your watch frequently comes into contact with water and or is worn during sporting activities.
  2. Bracelet sizes may vary as they are not always supplied to us with the full set of links. Please refer to the relevant Listing on our Website for details of the bracelet size for each Item.
  3. If the Item(s) are sold with Paperwork, the age of the watch is calculated from the date of the official stamp of the authorised dealer. It is important to note that the date of the manufacture of the Item(s) could be significantly earlier than the date of the stamp on the Paperwork. If the Item(s) are sold without Paperwork, it is difficult for us to calculate accurately the age of the watch, and as such, the listed age of the Item(s) on our Website are estimates only. If the Item(s) are sold without Paperwork, no representation or warranty, express or implied, is made by us in relation to the accuracy of the age of the Item(s).

9. LIABILITY

  1. We try to keep Chronotrade Limited and its Services safe, secure, and functioning properly, but we cannot guarantee the continuous operation of or access to our Services. Notification functionality in Chronotrade Limited's Services may not occur in real time. Such functionality is subject to delays beyond Chronotrade Limited's control.
  2. We (including our directors, agents and employees) shall not be liable to you in contract, tort (including negligence) or otherwise for any business losses, such as loss of data, profits, revenue, business, opportunity, goodwill, reputation or business interruption or for any losses which are not reasonably foreseeable by us arising, directly or indirectly from:
    1. your use of or inability to use our Services;
    2. pricing, postage, packaging or other guidance provided by Chronotrade Limited;
    3. delays or disruptions in or to our Services;
    4. viruses or other malicious software obtained by accessing, or linking to, our Services;
    5. bugs, errors, or inaccuracies of any kind in our Services;
    6. damage to your hardware device from the use of any Chronotrade Limited Services;
    7. the content, actions, or inactions of third parties;
    8. a suspension or other action taken with respect to your account;
    9. your need to modify practices, content, or behaviour or your loss of or inability to do business, as a result of changes to these terms and conditions.
  3. You accept sole responsibility for the legality of your actions under laws applying to you and the legality of any Item(s) you post on our Website.
  4. Whilst we employ practices and techniques with the objective of verifying the accuracy and truth of the information provided by our users, user verification on the internet is difficult. Chronotrade Limited cannot and does not confirm, and is not responsible for ensuring, the accuracy or truthfulness of users' purported identities or the validity of the information which they provide to us or post on our Website.
  5. Notwithstanding the previous clauses, if we are found to be liable, our liability to you is limited to the greater of either (a) the price detailed in the latest Listing on our Website for your Item(s), or (b) a current trade valuation of your Item(s).
  6. Nothing in this agreement shall limit or exclude our liability for fraudulent misrepresentation, for death or personal injury resulting from our negligence or the negligence of our agents or employees or for any other liability that cannot be limited or excluded by law.

10. ENTIRE AGREEMENT/WAIVER

  1. This agreement constitutes the entire agreement and understanding of the parties (you and ourselves, Chronotrade Limited) and supersedes all prior oral or written agreements, understandings or arrangements relating to the subject matter of this agreement.
  2. If there is any inconsistency between other communications and these terms and conditions, these terms and conditions shall prevail.
  3. No failure or delay on the part of either party to exercise any right or remedy under this agreement shall be construed or operate as a waiver thereof. The rights and remedies provided in this agreement are cumulative and are not exclusive of any right or remedies provided by law.

11. NO PARTNERSHIP

Nothing in this agreement, and no action taken by the parties pursuant to this agreement creates, or is deemed to create, a partnership or joint venture or relationship of or principal and agent between the parties.

12. FORCE MAJEURE

Chronotrade Limited shall not be in breach of this agreement if there is any total or partial failure of performance by it of its duties and obligations under this agreement occasioned by an act of God, fire, severe weather conditions, act of government or similar authority or state, war, act of terrorism, civil commotions, insurrection, embargo, or labour disputes.

This does not affect your statutory rights.

13. NOTICE

Any notice or communication to be given under this agreement shall be delivered or sent by first class recorded post and or by email to the address of the other party set out in this agreement. For the avoidance of doubt, our email address is: info@chronotrade.co.uk.

14. SEVERABILITY OF PROVISIONS

If at any time any part of this agreement is held to be or becomes void or otherwise unenforceable for any reason under any applicable law, the same shall be deemed omitted from this agreement and the validity and/or enforceability of the remaining provisions of this agreement shall not in any way be affected or impaired as a result of that omission.

15. THIRD PARTY RIGHTS

A person who is not a party to this Agreement (including any employee, officer, agent, representative or sub-contractor of either party) shall not have the right (whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise) to enforce any provision of this agreement without the express prior agreement in writing of the parties.

16. OUR RIGHT TO VARY

  1. We have the right to amend these terms and conditions from time to time.
  2. The terms and conditions that are in place when you agree to them will remain in force unless we are obliged to change our terms and conditions in line with governmental or legal requirements.
  3. If we notify you of any changes to our terms and conditions and you have not yet agreed to proceed with the sale of your Item(s) via Chronotrade Limited, then we will assume that you have accepted the changes to our terms and conditions.

17. LAW AND JURISDICTION

This agreement and any issues, disputes or claims arising out of or in connection with it (whether contractual or non-contractual in nature such as claims in tort, from breach of statute or regulation or otherwise) shall be governed by, and construed in accordance with, the laws of England and Wales and each of the parties irrevocably submit to the exclusive jurisdiction of the English Courts.

Selling Watches

INTRODUCTION

These terms and conditions will apply to any agreement (contract) between us for the sale of your watch through us. Please make sure that you understand them, before selling any Items through us. By selling your watch through us, you agree to these terms and conditions and the other documents specifically referred to in it.

If you do not accept these terms and conditions, you will not be able to sell your watch via the Chronotrade Website.

Please read these terms and conditions in conjunction with our "Data Privacy Policy".

2. CHRONOTRADE LIMITED'S AGREEMENT WITH YOU

  1. If you are a Business Trader, we will carry out due diligence checks on you once you have set-up your account with us. We reserve the right, further to carrying our due diligence checks, to refuse you trade access to our Website.
  2. If you are a Private Seller or a Business Trader, you can choose to sell your Item(s) via the online shop area of our Website, or via the auction area of our Website. Please note that only Business Traders can buy Items from the auction area of our Website. (Please refer to the terms and conditions entitled "Buying a Watch" found on our Website.)
  3. If you wish to sell your Item(s) through us you will need to give us information about your watch, including its make, model, serial number, age, dial colour, bracelet material, case material, and general condition, by entering the relevant details on our Website.
  4. The information you provide us about your Item(s) must be complete and accurate. If you provide inaccurate, false or misleading information, it may result in us not accepting your Listing.
  5. We reserve the right to amend or withdraw the Listing at any time without liability to you. If we reject your Listing, we will email you with a rejection reason(s).
  6. If you receive a sales offer from a buyer for your watch on our Website and you accept the offer, we will notify you once we have received payment for your watch from the buyer. You will then need to arrange for the watch to be posted to our offices in accordance with the information set out in the section entitled "Delivery" in these terms and conditions.
  7. On receipt of your watch at our Delivery Address, the sale of your watch is subject to due diligence and authentication checks which will include a search through The Watch Register. If your watch matches an Item on The Watch Register's database of stolen watches then Chronotrade Limited will be legally obliged to secure the watch and inform the police. In this event, we will not make a payment to you. It will be your responsibility to contact the Watch Register and resolve the matter. Regardless of the due diligence and or authentication checks we may carry out, you will remain fully responsible for the Items, and any checks we carry out shall not reduce, remove or otherwise affect your obligations under your agreement with us, including without limitation those listed under "Your Obligations" in these terms and conditions.
  8. Once the buyer has paid us and has received your watch we will pay you the agreed sum by bank transfer. We will notify you of each stage of the process. Please see the "Payment" section below. The agreement (contract) between us will only exist when you have accepted the sales offer on our Website, and we have received delivery of your watch.
  9. If you visit our store to deliver your watch, we will need you to produce two forms of original identification, as detailed in the section below entitled "Identification".
  10. You can track the various stages of the process via your account on the Chronotrade Limited Website. We will also provide you with email notifications throughout the process.

3. PRICE AND PAYMENT

  1. All prices shown on our Website and all payments made by us will be in Great British Pounds (GBP) Sterling. If you need to refund any sum to us, this will also be in Pounds Sterling. Any exchange rates that may apply will be your responsibility. Please note that refunds may be affected by any such applicable exchange rates.
  2. We will pay you 14 days after the buyer:
    1. has received the Item(s) and
    2. has confirmed he/she is satisfied with the Item(s) and
    3. has paid us in full for the Item(s).
  3. If you are selling a watch via the online shop area of our Website, we will pay you the price detailed on the Listing you made on our Website less our commission fees. Please read section 4 below entitled “Commission Fees”.
  4. If you are selling a watch via the auction area of our Website, we will pay you the highest bid offer accepted by you once the auction period has ended, less our commission fees. Please read section 4 below entitled “Commission Fees”.
  5. We will make payment only to the bank account that you advise us of. It is important to note that you must enter your bank details and that you are responsible for ensuring the accuracy of the bank account details you provide us. We will not accept liability if you provide us with inaccurate bank details.
  6. We will pay you via BACS (Bank Automated Clearing System) transfer. It may take approximately 7 Business Days for cleared funds to arrive after payment has become due. We accept no liability for any delay which is unavoidable in the circumstances. We reserve the right to pay you by any other payment method when reasonable circumstances dictate.
  7. We expect to make payments directly to you and not to anyone else or any third party on your behalf.
  8. If we discover that the watch is lost, stolen, fake or damaged or is not fully owned by you or that any other obligation provided by you as detailed in the section in these terms and conditions entitled “Your Obligations” is breached, we reserve the right without prejudice to any other rights and remedies we may have to rescind our agreement (contract) with you. If we choose to exercise this right, we will notify you by telephone and or email as soon as possible. In this event, we will not pay you for your Item(s). If we have already made payment, you must refund us the full purchase price paid within 7 days of receiving notice from us, and we also reserve the right to charge you an administration fee of £100.
  9. Any outstanding sums of money you owe to us will be deducted from any payment we make to you.
  10. The price quoted excludes import duty or any other taxes.
  11. We will deduct our commission fee from the price detailed in the Listing. See the section below entitled “Commission Fees” in these terms and conditions.
  12. You must pay all sums of money due under these terms and conditions in full without any deduction except as required by law and you will not be entitled to apply any credit, set-off or counterclaim against us in order to justify withholding or reducing payment of any such amount in whole or in part. We may at any time, without limiting any other rights or remedies we may have, set off any sums you owe us against any sums we are due to pay you.

4. COMMISSION FEES

The table below details our commission fee structure:

Please note that for an Item to be listed at £25,000 or above, the Commission Fees will be priced on application. Please contact us using the contact details shown on our Website.

5. DELIVERY TO US

  1. You will deliver your Items to our business Delivery Address. (Please refer to the "Definitions" section above).
  2. Insurance, carriage, packing, packaging, and any duty, taxes and or applicable charges will be your responsibility and at your cost unless we agree otherwise.
  3. It is your responsibility to ensure that the Items are properly packed, packaged and secured taking into consideration the stresses and strains of transit so that the Items reach the Delivery Address in good condition. Please refer to the Guides on our Website detailing how to package and post your Item(s).
  4. Once we have received your Item(s), we will notify you that we have receipt of your Item(s). You must ensure that all Items posted to us are accompanied by a sales slip which you should print off from our Website. If you do not send a sales slip with your Item(s), we may not be able to complete the sales process or there could be a delay in processing your Item(s) on arrival at the Delivery Address.
  5. You acknowledge that you will deliver the Item(s) to the Delivery Address at your own risk. We advise that you obtain proof of postage. If you decide not to proceed with a sale for any valid reason, you will be responsible for the carriage, packaging and insurance costs of us returning the Item(s) to you.
  6. Delivery of the Item(s) will be deemed complete once we have unpacked the Item(s) at the Delivery Address.
  7. Once at the Delivery Address, we will confirm receipt of your watch and it will be subject to due diligence checks. If you are Private Seller we will also carry out authentication checks on your Item(s). This process will usually take no more than 4 Business Days.
  8. There may be certain exceptional circumstances in which we may agree to collect the Item(s) directly from you. In this event, we will agree the details with you directly and in advance.

6. RISK AND OWNERSHIP

  1. Your watch will be our responsibility from the time of the completion of the delivery to the Delivery Address.
  2. Ownership of the Item(s) will pass from you to the buyer when the agreement (contract) is completed between us as described above in the section entitled "Chronotrade Limited's Agreement With You" in these terms and conditions.

7. UK ONLY SALES

If you are not resident or you are not based in the UK, we will not accept your listing.

8. YOUR OBLIGATIONS

You are fully responsible for any breach of the following conditions, and you agree that:

  1. all the information that you have provided to us before completion of an agreement (contract) under “Chronotrade Limited's Agreement With You” as detailed above, is true, accurate and complete;
  2. the Item(s) correspond with their description and you have not hidden any fact or matter concerning the characteristics, quality, history, provenance, identity, authenticity, legal status of the Item(s) which might be regarded by a reasonable buyer as material to making a decision in respect of buying the Item(s);
  3. the Item(s) are of satisfactory quality (as defined in the Consumer Rights Act 2015) and as described and are fit for any purpose you describe or make known to us expressly or by implication;
  4. you own the Item(s) and you are entitled to sell the Item(s) free from any burden, charge or claim, including any rental agreement, hire purchase or similar burden;
  5. the watch has not been reported to the police or any other authority as lost or stolen;
  6. the watch has not been reported to the manufacturer;
  7. the watch is not subject to a finance agreement that you have not disclosed to us;
  8. no one else has any claim to the watch, whether legal, personal or otherwise;
  9. the watch has not been modified or tampered with and is free from defects in material, design and workmanship;
  10. there are no physical defects with the watch that you have not disclosed to us;
  11. the watch has not been an insurance write-off or subject to substantial repairs;
  12. if you state in your listing that your Item(s) comes with a box and or documentation (paperwork), you will deliver the box and or documentation (paperwork) in accordance with description in the listing of your Item(s);
  13. the serial numbers and documentation are original, genuine and accurate;
  14. the listing of your Item(s) on the Chronotrade Website will be at a price that is no more than the price you have listed for the same Item(s) on any other website;
  15. you accept that all aspects of the description of the watch, including its make, model and serial number, are an essential part of its identity and that the absence or non-performance of any such part makes the watch fundamentally different from the watch that you have agreed to supply;
  16. you are selling your Item(s) from within the UK only. Note that we do not accept the sale of Item(s) from outside of the UK.
  17. if you describe in your listing that there is a warranty with your Item(s), you accept that any such warranty is valid and authentic.

9. CHRONORADE LIMITED'S REMEDIES

In addition to our rights according to statute and common law, we have the following rights and remedies:

  1. If the Item(s) you supply do not comply with information you have provided us and or you breach any of the obligations outlined in the section entitled “Your Obligations” in these terms and conditions then, without limiting any of our other rights or remedies, we will have the right to any one or more of the following remedies, whether or not we have accepted the Item(s):
  2. to terminate the agreement (contract) with you;
  3. to reject the Items (in whole or in part) and return them to you at your own risk and expense;
  4. to require you to provide a full refund of the price of the rejected Items if you have been paid by us;
  5. to claim damages for any other costs, loss or expenses incurred by us which are in any way attributable to your failure to carry out your obligations under the agreement (contract) between us, including the charge of an administration fee of £100.

10. YOUR IDENTITY

  1. If you come to our store to sell your watch, we will require you to provide us with proof of your identity and proof of your address.
  2. We will need you to produce either an original current valid passport or an original current valid driving licence to prove your identity.
  3. We will need you to produce an original recent utility bill, recent bank statement or an original recent council tax bill to prove to your address.

11. LOSS OR DAMAGE

  1. If you post an Item to us, and in the unlikely event it is lost, damaged or stolen whilst in our control, assuming that you can prove that you posted the Item to us and assuming that it was delivered to us in line with the information provided by the tracking Service, then we will compensate you for the lost or damaged Item. The compensation (settlement) amount we will pay you will not exceed the price detailed in the latest accepted sales offer as listed by you, for the Item(s) on our Website at the time the Item(s) were lost, damaged or stolen.
  2. We will transfer the settlement amount owed to you once we have received the settlement from our insurers for the same.

12. DATA PRIVACY

Please refer to the Data Privacy Policy set out on our Website.

13. LIABILITY

  1. We try to keep Chronotrade Limited and its Services safe, secure, and functioning properly, but we cannot guarantee the continuous operation of or access to our Services. Notification functionality in Chronotrade Limited's Services may not occur in real time. Such functionality is subject to delays beyond Chronotrade Limited's control.
  2. We (including our directors, agents and employees) shall not be liable to you in contract, tort (including negligence) or otherwise for any business losses, such as loss of data, profits, revenue, business, opportunity, goodwill, reputation or business interruption or for any losses which are not reasonably foreseeable by us arising, directly or indirectly from:
    1. your use of or inability to use our Services;
    2. pricing, postage, packaging or other guidance provided by Chronotrade Limited;
    3. delays or disruptions in or to our Services;
    4. viruses or other malicious software obtained by accessing, or linking to, our Services;
    5. bugs, errors, or inaccuracies of any kind in our Services;
    6. damage to your hardware device from the use of any Chronotrade Limited Services;
    7. the content, actions, or inactions of third parties;
    8. a suspension or other action taken with respect to your account;
    9. your need to modify practices, content, or behaviour or your loss of or inability to do business, as a result of changes to these terms and conditions.
  3. You accept sole responsibility for the legality of your actions under laws applying to you and the legality of any Item(s) you post on our Website.
  4. Whilst we employ practices and techniques with the objective of verifying the accuracy and truth of the information provided by our users, user verification on the internet is difficult. Chronotrade Limited cannot and does not confirm, and is not responsible for ensuring, the accuracy or truthfulness of users' purported identities or the validity of the information which they provide to us or post on our Website.
  5. Notwithstanding the previous clauses, if we are found to be liable, our liability to you is limited to the greater of either (a) the price detailed in the latest Listing on our Website for your Item(s), or (b) a current trade valuation of your Item(s).
  6. Nothing in this agreement shall limit or exclude our liability for fraudulent misrepresentation, for death or personal injury resulting from our negligence or the negligence of our agents or employees or for any other liability that cannot be limited or excluded by law.

14. ENTIRE AGREEMENT/WAIVER

  1. This agreement constitutes the entire agreement and understanding of the parties (you and ourselves, Chronotrade Limited) and supersedes all prior oral or written agreements, understandings or arrangements relating to the subject matter of this agreement.
  2. If there is any inconsistency between other communications and these terms and conditions, these terms and conditions shall prevail.
  3. No failure or delay on the part of either party to exercise any right or remedy under this agreement shall be construed or operate as a waiver thereof. The rights and remedies provided in this agreement are cumulative and are not exclusive of any right or remedies provided by law.

15. NO PARTNERSHIP

Nothing in this agreement, and no action taken by the parties pursuant to this agreement creates, or is deemed to create, a partnership or joint venture or relationship of or principal and agent between the parties.

16. FORCE MAJEURE

Chronotrade Limited shall not be in breach of this agreement if there is any total or partial failure of performance by it of its duties and obligations under this agreement occasioned by an act of God, fire, severe weather conditions, act of government or similar authority or state, war, act of terrorism, civil commotions, insurrection, embargo, or labour disputes.

This does not affect your statutory rights.

17. NOTICE

Any notice or communication to be given under this agreement shall be delivered or sent by first class recorded post and or by email to the address of the other party set out in this agreement. For the avoidance of doubt, our email address is info@chronotrade.co.uk.

18. SEVERABILITY OF PROVISIONS

If at any time any part of this agreement is held to be or becomes void or otherwise unenforceable for any reason under any applicable law, the same shall be deemed omitted from this agreement and the validity and or enforceability of the remaining provisions of this agreement shall not in any way be affected or impaired as a result of that omission.

19. THIRD PARTY RIGHTS

A person who is not a party to this Agreement (including any employee, officer, agent, representative or sub-contractor of either party) shall not have the right (whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise) to enforce any provision of this agreement without the express prior agreement in writing of the parties which agreement must refer to this Clause 19.

20. OUR RIGHT TO VARY

  1. We have the right to amend these terms and conditions from time to time.
  2. The terms and conditions that are in place when you agree to them will remain in force unless we are obliged to change our terms and conditions in line with governmental or legal requirements.
  3. If we notify you of any changes to our terms and conditions and you have not yet agreed to proceed with the sale of your Item(s) via Chronotrade Limited, then we will assume that you have accepted the changes to our terms and conditions.

21. LAW AND JURISDICTION

This agreement and any issues, disputes or claims arising out of or in connection with it (whether contractual or non-contractual in nature such as claims in tort, from breach of statute or regulation or otherwise) shall be governed by, and construed in accordance with, the laws of England and Wales and each of the parties irrevocably submit to the exclusive jurisdiction of the English Courts.

22. CANCELLATION POLICY

  1. You have the right to cancel this agreement without giving us a reason, further to accepting a sales offer for your watch via our Website if either:
    1. You have not yet posted your watch to us for sale;
    2. You have posted your watch to us and we have received it but we have not yet sent it to the buyer.
  2. In the above scenarios (as outlined in Clauses 22.1.1 and 22.1.2), we will return your watch to you. You will be required to pay us a £100 administration fee.
  3. If you have agreed to the sales offer on our Website, and we have already sent your watch to the buyer, then we cannot return your watch to you.
  4. We do not offer any refunds in respect of cancellation.
  5. In the above scenarios (as outlined in Clauses 22.1.1 and 22.1.2) you must notify us in writing about your intention to cancel. Please refer to the Section entitled "Notice" in these terms and conditions.
